FKE and the National Social Security Fund (NSSF) have formed a technical team to try and resolve the stand-off over the implementation of the new NSFF Act 45 of 2013. This comes after the Management Board of FKE led by the National President Mark Obuya held a joint retreat with the NSSF Board of Trustees in Mombasa.

Speaking after the signing of the agreement between the two parties FKE National President Mark Obuya welcomed the meeting and reiterated FKE’s vision of in a strong, efficient and accountable NSSF that is able to grow and invest workers contributions prudently. The National President also expressed the need for an amicable and consultative relationship between the Government, Workers, and Employers as far as the management of NSSF is concerned.

“FKE will continue advocating for an approach that ensures the members get adequate and superior benefits at minimal cost; the NSSF model that will ensure responsibility and accountability in our actions and decisions.” He added.

The contentious areas include section 18 that set up the pension scheme, section 19 on the registration of employers and employees, section 20 on the collection of new contribution rates and section 71 on regulation of the Fund by the Retirement Benefits Authority (RBA).

During the retreat, FKE CEO Jacqueline Mugo presented the key issues that employers wanted addressed. They included the implementation date, gratuity, pensionable earnings, deductions to seasonal employees, nomination of beneficiaries and tax harmonization.

NSSF Chairman, Gideon Ndambuki noted that once the outstanding issues are resolved the matter will be taken court with the hope that an ongoing case on the contentious issues will be withdrawn.

“The team has agreed to finish its work as soon as possible so that we can register consent before the matter comes for hearing which we believe would have the case before the court withdrawn,” said Ndambuki.

The agreement was witnessed by Principal Secretary for Labour, Khadijah Kassachoon, NSSF acting Chief Executive Officer, Dr. Anthony Omerikwa among other FKE and NSSF officials.
