On 30th May 2020, the Federation of Kenya Employers (FKE) entered into a framework agreement with the Ministry of Labour and Social Protection and the Central Organization of Trade Unions Kenya (COTU) to address emerging labour and employment issues during the Corona Virus pandemic period from a common understanding.

The Memorundum of Understanding (MOU) recognizes the importance of social dialogue and utmost good faith to support and manage both the business and to save jobs during the pandemic.

The FKE’s Chief Executive Officer, while signing the agreement appreciated this effort as a timely Labour Day gift for employees and employers. “We continue to appeal for a balanced approach in managing labor relations during this pandemic phase since the survival of enterprises means the protection of jobs and livelihoods,” she said. All parties agreed that cushioning jobs and enterprises remained a priority for the industry.

In managing labour relations in the country in these unprecedented times, the agreement pleads for flexibility between the parties involved in making operational adjustments in the workplace such as suspension of CBA’s, pay cuts , unpaid leave and freezing wages among others. Kenya joins other countries like Germany, Italy, Denmark and South Africa that have developed framework aimed at protecting employees. The President of BDA (Confederation of German Employers’ Association), Ingo Kramer noted that the partners of the agreement had achieved an extremely fast and important result for the industry. “This proves that the partners can find solutions, especially in difficult times,” quipped Mr. Kramer.

The key proponents of Kenya’s MOU include reporting of employees affected by Covid- 19, collection of data to inform suitable mitigation measures, support to government interventions, safety and health at the workplace and commitment to social dialogue for harmonious labor relations.
